In New Jersey, family law cases like divorce usually end in one of two ways: a settlement or a trial. Most cases are settled through negotiation. For instance, if a divorce goes to court, mandatory economic mediation is one of the final steps, and parties must participate unless they settle beforehand. Mediation is confidential. Offers made during mediation stay private and cannot be used in court. This is important because it encourages parties to settle without fear of it affecting their case. The court process is designed to push for settlement at various stages, including custody mediation, the Early Settlement Panel (where attorneys give feedback), and economic mediation. As a last step before trial, parties often meet with a judge for an intensive settlement conference.
